DISTANCE SALE CONTRACT
1. CONTRACTUAL PARTIES
paribucineverse.com (hereinafter referred as “Paribu Cineverse”) residing in Dereboyu Cad. Ambarlıdere Yolu No: 4 Kat:1 Ortaköy, Beşiktaş/Istanbul on one hand and the Consumer (hereinafter referred as “Customer”) purchasing the tickets from paribucineverse.com web site on the other hand, have hereby entered into and executed the contract herein on the following terms and covenants.
2. SUBJECT OF THE CONTRACT
The subject of the contract herein, consists of the service of selling the tickets regarding the purchasing of cinema movie and event tickets in electronic environment over paribucineverse.com web site and of the determination of the mutual rights and liabilities of the parties according to the provisions of Consumer Protection Code and Regulation about Distance Contracts.
3. USAGE TERMS
The Customer hereby accepts and declares that he has read the texts titled “Usage Terms” and “Confidentiality” located on the web site paribucineverse.com and that he acquired complete information about the usage terms and confidentiality clauses herein.
4. GENERAL TERMS ON SALES AND SERVICES
4.1. The Customer will be able to see the price of the movie tickets on the web site if he makes the selection.
4.2. Cinema movie / event tickets may be purchased over paribucineverse.com only with bank card or credit cards. The Customer, in case he purchases tickets over the internet, he will be offered with credit or bank card options in order to choose one for payment. The Customer will then pick up one of the credit or bank card options, which are fit for him, and will complete the purchasing.
4.3. The ticket prices may change depending on the current locations, cities, movie, event and dates. The Customer hereby accepts and acknowledges the said change of ticket prices. The ticket prices are all taxes and fees inclusive; however the service fee regarding the web sales of the tickets are not included. paribucineverse.com is hereby entitled to adjust the price regarding the web tickets sales services. The Customer hereby accepts and acknowledges the changes which will be implemented regarding the web tickets sales services.
4.4. A service fee determined by paribucineverse.com is charged by paribucineverse.com for each operated ticket. By purchasing tickets from paribucineverse.com the use is deemed as accepting to pay the said fees.
4.5. The cinema movie tickets purchased over paribucineverse.com may be received only from the related movie theaters.
4.6. The cinema movie tickets may be purchased over paribucineverse.com maximum 10 minutes before the running of the movie.
4.7. The cinema movie tickets not used at the stated running times become invalid and the service fee is not redeemed and / or the tickets cannot be changed.
4.8. The Customer cannot purchase more tickets than the maximum number of tickets allowed by Paribu Cineverse. The Customer cannot sell the purchased tickets illegally over the black market.
4.9. paribucineverse.com and all of its partners, employees, or content providers cannot and will not be held liable due to errors, mistakes and negligence which may arise at paribucineverse.com independently from its reasons and terms and from the damages likely to occur due to disinformation or delays. paribucineverse.com and all of its partners, employees, or content providers are not accepting any liability due to receivable claims to be risen by the Customer and 3rd parties, under the form of reimbursement, charges or whatsoever form.
4.10. The liability of controlling and storing regarding the purchased cinema movie / event tickets belongs to the Customer. Customer will be held liable due to the damages arising from failure to fulfill this liability.
4.11. By purchasing cinema movie/event ticket over Marsgatde.com.tr you are deemed as: - Accepting the chair you selected for each cinema movie / event ticket purchased. - Accepting that paribucineverse.com has reserved the right of refuse to sell the cinema movie tickets, cancel the sale of the cinema movie tickets or change/cancel the running times and halls of the movies at its own option and / or due to technical issues.
4.12. The age classification of the related movies, as imposed by the Ministry of Culture shall be taken into consideration while purchasing over paribucineverse.com. The tickets of persons who are not eligible for the age restriction of the related movies cannot be returned / cancelled and the paribucineverse.com employees cannot be held liable due to the issues which may occur.
4.13. The returning, cancelling or changing of the cinema movie tickets purchased over paribucineverse.com may be performed by calling Mars Call Center (0850 - 220 09 67) or by following the mentioned procedures at latest 1 hour before the running of the movie / event according to the terms stated in herein Contract. The ticket purchased 1 hour before the running of the movie / event cannot be returned. The online ticket sale service fee of 1,5 TL is not included within the returned amount.
4.14. For transactions initiated by an American Express or Debit Card, refunds are processed at related cinema box office.
5. RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract without any grounds, within seven days from the date of the contract. In order for the Customer to be able to usage his right of withdrawal he shall never have used the purchased service and / or the time lapsing to the running of the related movie / event shall exceed 1 hours provided that the period of 7 days for the right of withdrawal has not expired; otherwise the right of withdrawal becomes null. In case the customer uses his right of withdrawal within the prescribed term and duly, paribucineverse.com will return to the Customer the fee of the ticket purchased within maximum ten days as of date of receiving the notification of right of withdrawal. For transactions initiated by an American Express or Debit Card, refunds are processed at related cinema box office. The Customer shall use his right of withdrawal in writing or by informing the withdrawal to the contact form or e-mail address of paribucineverse.com. The online sales service fee is not included in the returned amount.
6. MISCELLANEOUS
6.1. The information regarding the sales of the tickets, shall be recorded by Paribu Cineverse and in case of any discrepancy, the records of the sale shall be submitted to the related establishments and departments.
6.2. Paribu Cineverse is not responsible from price and content errors which may occur due to the string and system errors on the web site owned by Paribu Cineverse.
6.3. The Customer hereby accepts, acknowledges and undertakes that he will act according to all the terms included in the Contract herein, the Usage Terms and all the conditions on the web site, during the usage of the latter and also to the explanations provided on the web site and all the current regulations, otherwise he will incur every kind of legal, penal and financial liability which may arise due to usages infringing the said notifications and laws.
7. SETTLEMENT OF DISPUTES
The Consumer Issues Arbitration Board from the location from where the Customer has purchased the service or resides, is authorized within the financial limits determined by the Ministry for the disputes arising due to the enforcement of the Contract herein.
8. ENFORCEMENT
The Customer will be deemed as accepting all the terms of the contract herein, together with the payment of the order given over the web site, after the acceptation and approval of this contract and the contract will be hereby enforced. The Customer hereby accept, declares and undertakes that he owns accurate and complete information regarding the type of service subject of this contract, the sales price, the type of payment, the right of withdrawal from the contract and all the rights and liabilities arising from the contract and that also he has not any objections.

2. TYPE OF THE SERVICE SUBJECT TO CONTRACT
The price of the ticket will be displayed on the web site during the purchasing operation. All the fees and taxes are included within the ticket’s price.
Cinema movie / event tickets may be purchased over paribucineverse.com only with bank card or credit cards. The Customer, in case he purchases tickets over the internet, he will be offered with credit or bank card options in order to choose one for payment. The Customer will then pick up one of the credit or bank card options, which are fit for him, and will complete the purchasing.

By purchasing tickets from paribucineverse.com the use is deemed as accepting to pay the said fees. The online ticket sale service fee of 1,5 TL is not included to the price of the ticket. paribucineverse.com has reserved the right of adjusting the service fee regarding the online sales. The Customer hereby accepts and acknowledges that changes may occur in the fee regarding the online ticket sales service.
The cinema movie tickets may be purchased maximum 10 minutes before the running of the movie over paribucineverse.com.
The cinema movie tickets which are not used in the relevant time, become null and the service fee is not returned and / or the ticket is not replaced.
3. RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract without any grounds, within seven days from the date of the contract. In order for the Customer to be able to usage his right of withdrawal he shall never have used the purchased service and / or the time lapsing to the running of the related movie / event shall exceed 1 hours provided that the period of 7 days for the right of withdrawal has not expired; otherwise the right of withdrawal becomes null. 4. AUTHORIZED COURT
The Customer shall file his complaints and objections regarding the discrepancies arising due to the implantation of the Contract herein, within the monetary limits imposed by the Ministry, to the Consumer Issues Arbitration Board from the place where he purchased the service or he resides.
The distant contract phase will be enforced following the reading and acceptation by the Customer in electronic environment of this pre-information form.
The Customer hereby accepts, acknowledges and undertakes that he has read, accepted the articles of this pre-information form and he has not any objections.
